Boat Charter Terms and Conditions
1. Definitions
- Client: The individual or entity chartering the vessel.
- Company: The boat chartering company.
- Vessel: The boat or yacht being chartered.
2. Booking and Payment
- The booking is confirmed when the advance payment is received from the client.
- The full amount of the advance payment must be settled before the charter begins.
- All balance payments are due no later than 1 month prior to the yacht charter.
3. Charter Price
- The price for yacht charter includes:
- Vessel costs
- Moorings and usual harbor dues
- Fuel for cruising (usually up to 4 hours per day)
- Ship’s laundry
- Half board (breakfast and lunch) for the charter party
4. Additional Services (Extras)
- Extras may include:
- Skipper services
- Gennaker or auxiliary engine
- Transfers
- Additional equipment (as agreed upon)
- Any requested extras must be confirmed in writing at least 10 days prior to the charter start date.
5. Berthing Fees
- If the yacht charter starts or ends in an alternative base (other than the homeport), berthing fees in the alternative base are not included in the charter price.
- The client acknowledges that any berthing fees in the alternative base must be settled separately.
6. Cancellation and Refunds
- If the client cancels the vessel booking after the stated deadlines, the company reserves the right to retain the advance payment.
- The company may cancel the booking without refunds if the client fails to settle the balance payment.
7. Trading Warranties
- The charter contract specifies where the vessel can go (trading warranties).
- The client must adhere to these trading warranties during the charter period.
8. Insurance
- The client must carry the required insurance while operating the vessel.
- The company will provide details on the type of insurance needed.
9. Crew and Services
- Crew wages, food, and ship’s laundry are included.
- Crew standards, permitted cargoes, and indemnity agreements apply.
10. Miscellaneous
- The charter contract is governed by the laws of the relevant jurisdiction.
- Any disputes shall be resolved through arbitration.
